We will pay particular attention to debts and income in capital poor cases and division and meeting needs where there is little to divide. A consideration of capital, liabilites, income and the main cases which impact upon modest asset cases
Each element will contain recent case law on division in modest asset cases and how needs are interpreted when there is not enough to go around
We will pay particular attention to liabilities, insolvency and even no capital asset cases using recent case law examples to consider how the court approaches division when liabilities can be a real stumbling block
Periodical payments in small capital asset cases: when is this appropriate, stepped orders, particularly for young parties and management of income need where capital is scarce

On 2nd July 2025, the Supreme Court handed down the long anticipated judgment in the case of Standish v Standish [2025] UKSC 26. Over just 14 and a half minutes Lord Burrows provided a focused and clear analysis of marital acquest. This lecture will consider the take aways from the Court of Appeal and Supreme Court judgment.
